Hacking 3ds game legitimacy question?

I may be getting a n3dsxl soon on 11.5. I was looking through the DSi ware injection list and found one of the games I had (Mario V.S Donkey Kong Minis March Again) which I had gotten from club Nintendo before it shut down. I deleted it because I never played it and now have tikshop installed on my 3ds. Now if I re-download the game to install CFW on the n3dsxl, is my copy legitimate or pirated? Thanks!

If the ticket is still on the unit. Then yes it would be treated as a legitimate copy.

Sure. As long as you haven't deleted the ticket using tiksweep or something.
