1. Does a hacked 3ds get banned from online by being hacked?
2. I read about internet ban. Is that still a thing?
3. 3ds.guide says about removing friend list and turn off spotpass which makes sense but has anyone gotten banned from keeping them on?
4. Can I play online?

Ok there are only 3 ways to get online banned.

1. Cheating online.
2. Playing a game online before it's official realese date. (not a problem anymore as not really any new games coming out.
3. Using a stolen credit card in the eshop.

So yes you can safely play online if you don't do any of the above.

Can I keep spotpass on and my friend setring. I understand the friend setting can potential show the hacking software e.g. fbi. Which can cause an issue but unlikely your friends will report you to Nintendo.

I believe spotpass can be kept on but the friend setting must be turned off.
