Top screen flickering like CRAZY

okay so big problem: everything was fine with my n3dsxl until I installed a new splash theme and rebooted via the rosalina menu. after doing that, my screen started flickering and my top screen was covered by a black shroud like the one you have when you click the power button and the 3ds wants to shut down etc

this is what I see, idk if it's very noticeable I can't capture it well with my camera, also my screen flickers A LOT sometimes and it's giving me a headache
sometimes the flicker is calmer but still there, I tried deleting my splashes but it's still there, when I rebooted with rosalina before my 3ds froze and my bottom screen glitched before restarting

It could be a problem on the screen. I would download the CTR config and try the manual flickering values to find if it would resolve the problem or not.

This seems to be the issue but I don't see a fix except disabling Game Patching or the Splash screen.
