I'm sorry but this is just refusing to swallow the pill. We're talking 4 months as of this post with forget a release but not even an update on the progress of their CFW. "Heat" is irrelevant when everyday another person switches to using Atmosphere because it is actually receiving constant updates and more customers feel betrayed by a company that is no longer offering support for their product. Its not like Nintendo is going to stop paying attention to the Switch scene or TX anytime soon especially with the lawsuit filed against Gary so even if that was supposedly their plan, we would be talking potentially years of waiting. Furthermore, the last update was written by different developers indicating that the arrests have done a number on the regular TX staff and seeing as how there has not been an update since then, its likely those people were temporary and the old staff may be gone.Misinformation. Only Gary is in custody. Max, who is allegedly head of TX, is a free man in France, and Chen was not arrested, there is a warrant for Chen's arrest but there's no evidence that this Chen guy was even involved in TX. No programmers or hardware developers have been arrested as far as we know and the stuff for Gary's lawsuit is weak. N is trying to claim that SXOS connects to Nintendo's servers to activate itself, something that you yourself would be able to confirm is false since you're working on the SXOS crack.
It has been basically radio silence since the initial news of the arrests yet we have still seen updates to SX products. SXOS got updated to support 11.0.0 after the arrests and the SX Gear boot.dat was updated. IMO they're most likely only going to release updates when games aren't playable on SXOS, currently all games can be played on 11.0.0 so why release an update with all this heat?
There are some strong points in the lawsuit against Gary but a lot of it is flimsy and I don't think the majority of it will hold. Gary was also extradited to the US illegally. I haven't seen many people talking about it but Gary was arrested in the Dominican Republic and four hours later he was in custody in the US, he was supposed to be held in the DR for 24 hours and I really doubt he got his phone call before being shipped off to America.
I don't know how familiar you are with the Gateway situation but ironically since they are the same team, the current situation mirrors it extremely well. The only other difference is that Gateway departed on an empty promise of updating their CFW which TX did not but eventually the community had to accept that Gateway was dead. A lot of the community have already accepted the same for TX. At what point do you consider them dead? A year? 10 years? The answer is actually rhetorical because it doesn't change the fact that an update has not been pushed for months and this sets bad precedent for future updates because they can potentially take as long if not longer.
