Hey guys,

As a bit of background, purchased a switch roughly 2 years ago, its been offline ever since, with a clean nand backup of 3.0.1. In the meantime, been using SXOS etc.

Last week, I restored this switch to the clean NAND backup and then connected online with no problems. The one thing to note here is that I restored saves using checkpoint on Super Smash Bros, Pokemon Let's Go Pikachu and Mario Kart 8 Deluxe (as well as Zelda I think?). I've also had

Couple of days ago, I got Nintendo Switch Online and everything has been fine (using it for Pokemon Sword). Last night i played Tetris 99 (from the Switch Online)

This morning, I noticed I was banned. Called up Nintendo and they said that it was for using pirated software.

Heres the interesting part:
They said they could reverse the ban if I sent in my switch with the games I played recently and they could determine the ban was a mistake? I plan to do this as there's nothing much to lose. Not like they can confiscate my shit. The only thing that could possibly tick them off is a mismatch in play time between my switch profile and the save files? However this could be a result of clearing play data I assume?

My question is, has anyone ever been asked by Nintendo to do this and has anyone tried? what happened?

TLDR: Ban with (almost) all precautions taken. Will send in to Nintendo to see what they say.

That is NEW, they before just told you it was banned and that's it, they wont even say why xD '

Send it, you will lose nothing.

Nah I dont want them to 'fix' it and then send me a patched switch. Online play is a lot less valuable to me than being able to download games not gonna lie.

You realize banning for them is just a flag on their servers right? They could just remove it... or send you the patched version xD

Yeah, but I haven't actually heard of anybody successfully having a ban overturned, however several stories of them being forced to exchange their switch.

My guess is that even if they found nothing they would unban me and then send me a patched version... Like I said, if I had confidence in the transparency of the process, yes I would actually like to send in my switch and see what they can find

Not false, the unic legal copies that people get before release date are traced, mostly through eShop.

If you have a save before release date and they don't recognize your account as collaborator or betatester it's a proff that you use a leaked and ilegal copy, to use it you should run the leaked image on hacked Switch, it's very simple.
Umm... what? NO, that's not proof, and I don't believe that would ever be used as proof because it would never hold up in court. Stores don't receive games on release day. Millions of copies get delivered across several days, at least. Retailers make mistakes. As is my case with Chibi Robo game for the 3DS. I had that game more than a week ahead of release because it was put on the shelf. Big box with the included Amiibo, even. Now if the save file included game serial number information, then I could believe it was flagged (too many people with the same SN, just like when people go online without stripping out the cart SN first). It's definitely NOT the date though...

That’s very interesting that Nintendo told you they could reverse the ban, if you sent it in.. my first switch got banned for a very silly reason a very minor reason in my opinion so I rang Nintendo up and eventually spoke to a high level technician he told me it’s impossible to reverse a ban once it’s been processed, he stated it is a complete high vetted automated process and is “not wrong” he told me “it cannot be reversed” the only way to get back online is purchase a new switch and set your old account on the new one. I would be slightly curious if I was you, Nintendo asking you to send your console to them to reverse the ban unless eu Nintendo methods are different to us Nintendo, it could be that.

I would never ever send in consoles to Nintendo. I also have been playing online on atmosphere for months and have not been banned yet. I only injected my single game save from my banned unit to this switch and keep it in CFW and go play online daily, over 1.6k hours on this game now. all games are physical carts.

Me and another person already hacked the game with modified pokemons and all items. Also max money. No ban and it's been almost 2 weeks
Sorry for butting in, but, do you online?

I'd say that @Kingfield messed with games that have a very strong online presence: Super Smash Brothers, for instance. I'd wager that the user's stats didn't validate the online ones for something (unlockables, maybe?) and triggered a nasty ban.

Just my reasoning, but I'm almost sure that whoever hacks saves doesn't usually mess those exact games that @Kingfield edited in order to keep the console online.

Does playing a early leak of Super mario maker 2 on emunand and then transferring over the save file over to Sysnand at release date count?

Save datas dont have anything attached to them and neither do you need to be a collaborator or a beta tester to play a game before release date. Anyone can get a hold of a early digital copy of a game and will be fine playing it without receiving a ban

Where the hell are you guys getting these junk information from? Where's the mod when you need one? Get started deleting misleading information that isn't true. Reason why I'm never on this site often. Lies everywhere :gun:

Interesting, up front I did not read the entire thread due to a time constraint on my end. But Nintendo is stepping up in a lot of ways. Roughly 8 months or so ago I got my ban followed by a superban. I got it while doing nothing except backup my own games to use them digitally (not online, no editing, no sharing, nothing)
And that also led to a ban.

But I found out that having both a superbanned and a vanilla system is actually kinda great. But of course that is not a situation everyone would want.

i'm sorry but banning over game saves is so fucking stupid. also why did you use the eshop to buy Tetris 99? is that game only digital or not... i would never buy a digital game on CFW. that's like taking a bullet to the head IMO.

Yeah I'm not sure if they were trying to bait me into sending my switch in so they could replace it with a patched one? He did mention that there was some sort of automated score that was calculated and you get banned if you reach 100... and yep, I haven't found any records of anyone elsse getting a ban reversed which was one of the reasons I didn't send my switch in

Editing pokemon is fine for the most part illegal pkmn will just be unselectable in WiFi battles. The way I see it is that injecting saves from different ppl towards big online competitive games like Smash/Splatoon/MarioKart is an obvious ban the servers are keeping records of our playtime associated with our account. I hacked my 2nd clean switch "now with incognito emuMMC" just to dump/inject pkmn ss saves to my sysnand and still no ban even bought overwatch recently

Good call, it does sound very suspicious to me. I don’t know of anyone who has had a ban reverse yet so yes you did the right thing by keeping it at least for you, you can now use it exactly how you want to without worries I know the lack of online play is very frustrating but think of this, if you sent it in for Nintendo that’s a job well done for them another hacked model of the market but for you it was probably a patched replacement, good job!

Considering I now have two Switches... One banned and one not... You now have a portable piracy and homebrew machine. You no longer need to worry about staying offline in SX OS anymore. You can pirate any game you want, and if you end up getting a second Switch, you can do game updates locally to the banned Switch.
