You mean that I made a NAND backup to early and had to wait for Hekate to have the option to make a proper fully working backup?
When I was setting 90DNS I allways triple checked so I doubt that, and what do you mean by Nintendo Hotspot?
Hekate didn't have proper NAND backup verification for a long time actually. And the Switch has hardcoded network settings that it automatically connects to. These are usually found at Nintendo Hotspots.

The first Official Nintendo shop opened here In my country only last month and my switch was in airplane mode when I been there so I doubt it connected. Still a banned swittch is such a bummer especially after I kept my switch "safe" for so long..

Why are you wanting to step away from homebrew in the first place?
Because one of my friends got a switch and I want to play with him now but I dont want to take the risk of getting banned and also knowing that nintendo could just ban my account from any switch i would log into just scares me :/

If you mean play online with your friend, then there is no way to retain the save data and stop using homebrew. Homebrew is primarily used for backing up and restoring save data. Nintendo's online cloud feature was another option but this involves going online which is a ban risk.

If you have a clean NAND backup, you can restore that. By clean NAND backup, I mean a NAND backup made before ever running CFW or homebrew. If you do not have one, then there is no guaranteed way to avoid a ban.
Well then im done for since i only have a dirty nand backup

But what are my options for now? Would it just be better to leave my switch as is?

That's really up to you. Regardless if you keep your save data or not, if you want to play with your friend online, you risk a ban. If you choose to stay offline forever, you just ban yourself. Honestly, the best option is to get a second Switch.

Is it possible to transfer my save files from a banned switch to a new switch via the official switch save file transfer? And is there a risk in getting banned on the second console?

Main caution would be if you've modified your save files, particularly for online games. Especially if that is what got you banned in the first place.

The save data itself shouldn't be marked as "banned", but if Nintendo detected anything funny in it, they could find it again on your new Switch and ban it.

Additional Comments: I have been doing pretty much every naughty thing I could since the early SXOS days without ban. Up until a month ago, I decided to try to go legit and stop loading SXOS and re download all my purchased games from Nintendo shop. I even purchased some new games and even got a month of the Nintendo Online thing. After a few weeks of being legit I got banned "I was expecting this for a long time". One thing to note is that during the time I was using SXOS I didnt have a Nintendo account associated with the Switch. All I did online after the freeshop stopped working was to download any game updates from Nintnedo servers and never had an issue. It wasnt until I associated the console with my Nintendo account after going legit that I got banned.

I'm planning on getting the switch v2. I unlinked my account on my old banned switch through ninty's site after ingot banned. Is it OK to sign into the new switch with my account? And also is it OK to test to see if my cart games are cert banned or not?
