You're conflating a EULA (End User License Agreement) with the GPL Copyright License.

An EULA is not a legally binding contract. Instead, it's more of a "this is what we provide you as long as you follow the terms set henceforth". Ergo, breaking it only breaks the EULA and the services provided by signing the EULA can then be terminated at the whim of the other person if you break it. EULA violations are typically thrown out in court if they're deemed to be in conflict with other laws. (So in my situation -> the law permitting me to run custom stuff on my consoles trumps Nintendo's EULA).

On the other hand, a copyright license is closer to "criteria under which you can make use of this creation". Copyright law is very much stacked in favor of creators of content and a creator as a result has full control over how it is used, distributed, modified and derived from.

Unlike an EULA which is more "company says you cant do X but if you violate X, the worst they can do is cease your ability to access or use whatever they provided to you", copyright concerns actual laws that have been in place for nearly a century by now in the US, but in other countries since 1886. As a result, a copyright license is a legally binding agreement.

They're two completely different kinds of violations in terms of legal enforcability.

Thanks for the write up as I'm sure it will be beneficial to someone. You're doing more than just breaking Nintendo's EULA when running unsigned code thus bypassing security mechanisms. You're not licensed to do so and you're also using breaking all sorts of copyright laws by playing or facilitating the use of copied games.

I don't have a problem with homebrew only users as whilst they are still violating licensing agreements and what have you at least they're not blatant thieves (or pussies hiding behind homebrew).

I just don't like this "I'm better than you" cowardly bullshit when the entire aspect of the scene breaks some sort of license, law, contract, etc...
