If you have a linked Nintendo Account and you format the console, but the console is banned, you're going to get a persistent notification to connect to the Internet to unlink the account but it will never resolve and fail because the console cannot connect to Nintendo's network.

According to OP anyway, if you format the console, it should remove the nag. But I don't have a banned console to test so I can neither confirm nor deny this information. If you have formatted the console but are still getting a nag, maybe try my earlier recommended advice of calling Nintendo to unlink it from their server.

Neither would bypass the check because its performed internally as in within the console itself.
