I've fired up sx ox several times, and mess around a bit with lakka. Installed a game and loaded it to see that it ran, and started an xci of crash trilogy. Then this banwave started. Wasn't sure about myself, but I just grabbed crash on sale (physical copy) along with bayonetta 2. Deleted the software via management, and removed the xci and such from my SD card, then went to the eshop to claim the bayonetta 1 code. It worked, so I'm guessing I'm not banned.

and funny thing: I also picked up bayonetta2 for the Wii U because part 1 was free, and I saw some youtube reviewer mention something to the effect of "but dat as$ tho"
I have yet to play that game to this very day...

You mean cuz I only play XCIs offline and aren't banned yet that my plan isn't foolproof?! Even Tho I told 100's how to stay unbanned that way? /s

I never thought I'd *like* a ban wave lol
Oh goodness I think I remember what thread you are referring to. It's like the blind leading the blind, and with only "I haven't gotten banned yet so it must work flawlessly" as evidence.

Gameboy, your report is very interesting, if it is true, a proof for me that nand is the key to open the door, either ban, or not ban...

Kamesenin888
I am still unbanned, just use online for updates on games but when it happens i will log here lol
Update from xci to ofw? Not banned? So it's safe to say we'll be back with a completed form soon.
And to the question and you ban? [ Y ]

And without a crystal ball
Abracadabra ban...... Pouf....
Superbanned...nintendo magic

You're already dead but you don't know it yet.
Nintendo will do that to you!

Firmware?
Because in 5.1 it is a ban pattern, continue to convey false information, as say around you ,continue to update xci in ofw? Not banned? The right joke.

How do you say it?
What are you deleting? Creport puts the newspaper on sd card, dreport is another case, so the truth?
In this more secure way to remove the sdcard, why delete logs?
You use hack, and play on the same sd? Not ban?

I doubt very much that you will be banned at the next wave, short bought a surfboard
Or do you have a lucky charm? That I can buy a case of it for my friends
Nintendo has 3 rules for the ban
Internet ofw network
Nand modified ( by nsp or other app)
Log logs
You broke the 3 rules, and you'll hopefully miss the wave, yes, maybe good luck then

. The UI isn't similar to DevMenu but the basic process is. Actually, the built-in installer of SX OS is more similar to Tinfoil than DevMenu. Regardless of whatever installer you use, it will leave traces. And currently the only way to remove such traces is with a clean NAND backup made before hacking. If you don't have one, it might be best to stay offline if you care about being banned until the community devises a better way to remove such traces.
No one has been banned for only using homebrew to backup saves, although it might have contributed to some piracy-related bans. The only homebrew ban thus far was for a user who used gba emulators as well as clearing error logs on 5.X, the latter of which is not recommended.

4[/MEDIA]

the console is just a NO-FUSES BURNT console that ive progressively(bcuz of error logs and repeated mistakes) backed up and restored nand on. But the 5.1 fs.kip could be counted as CFW. Other than that everything works fine online and eshop (all retail and eshop bought of course). Ive never restored an old backup, when i back up the nand i delete the old one

Yes well understood, no problem for you, good road, and good games, continue your caution will save you until the end of the switch's life in 2025? Mouah! Ah! Ah! Ah!
( Be very careful, airplane mode before making a backup of nand....)..
But the 5.1 fs.kip could be considered as CFW.
You do what you want in offline mode, nintendo doesn't know you, will never know you...

Additional Comments

Used some NSP for like 70h of game. Then connect and linked my Nintendo Account for get the activity log few weeks ago, then today try to connect in the South Africa eShop to get a legit MK8D in OFW. Still not ban. If I'm not ban when the online service not free release, I'll pay for it.

As I said before, I'm almost sure that using homebrew ONLY does not result in ban (at least not for now).
I've been using my Switch like this for almost 4 months and always connected to the internet and no problem happened at all.
Things I did:
-used homebrews
-had errors
-kept connected to internet even in CFW
-restored to a clean NAND (AFTER having errors registered while using homebrew)
Things I didn't:
-used eshop on CFW
-played online on CFW
-played NSP or any other form of illegal Switch-native games
If you're on the same situation as me, I'd recommed to delete all cfw related files from the SD card before 6.0 releases. There's been at least two big ban waves as of now (September) and nothing happened to my console at least for now.
It's still all speculation, but looking at the spreadsheet I've noticed that practically all bans happened after using illegal switch games or connecting directly to Nintendo servers (with eshop or online games).
i'm not saying I'm 100% safe since there's no way to confirm that., But I'm leaned towards to believe that homebrews that don't access nintendo servers are safe.
I know this is a hot take (and not a popular opinion here), but...

Compagnon francais,le nsp modifie nand, ceci est un risque de ban sur ofw nintendo
Nsp = modification nand
Basically if you bought on the eshop titles, with your account and credit card, linked to the account
before superban would be a good idea to delimit the account, otherwise to the tel or by email what do you say?
I'm ban I hack, delete my credit card...

I did some online races on Mario Kart 8, if they ban me it's okay. I never save my CB informations.

I seem to notice you skipped a lot of questions, although I'm not sure why so if you could answer them, that would be great. I'll even copy and paste only the questions you missed.

I'm inclined to agree after collecting this data for almost 3 months now. I've managed to narrow down homebrew-only bans to one case and that person cleared error logs on a firmware that can track them being wiped. I think this pattern also fits most people's morals since pirates don't deserve online access although some people were banned despite backing up their own games. On the other hand, its only been a few months since the first and only banwave so only time will tell if homebrew can be considered safe or not.

I'll probably be useful to these datas because I'm on the exact same situation as the guy who (as he said at least) got banned for restoring NAND after having errors reported.
I did exactly the same. Let's see what happens when 6.0 releases.

Okay so I use ReiNX CFW with NSP installed games (this includes backups, devmenu, tinfoil, and Homebrew launcher) on firmware 5.1. I never have gone online except right when I bought the console (before I hacked it). In my understanding you don’t get banned following this method. You play your nsp games offline with CFW, and never connect to the internet using any Homebrew or CFW. You boot your switch into OFW and play purchased games online for normal play. You also never play, or update anything that you used in CFW like backups. My questions are should you clear your logs, or not? Does it matter if you installed devmenu, or any other custom nsp to your console if you don’t use them online? Can Nintendo still ban you for them being installed? Last question is, is this the confirmed method to not be banned?

No, the best way to avoid getting banned is banned is by making a clean NAND backup before hacking, staying offline with your hacks, and restoring it prior to going online. You also should never clear your error logs especially on 5.X and you should stay away from DevMenu as its original uses have been replaced.

Okay I don’t really have interest in having to restore my nand just to play online. Hopefully there’ll be a better solution later.
