It's not as simple as that. You can't expect me to unlock a bootloader from a phone, flash a custom rom, flash the stock again and relock the bootloader and complain that it's warranty should not be void.
The modification was there. It happened and the console likely logs that.
But i'm not claiming anything. He said when using an unmodified console the game should work. It can be as simple as that. Running stock firmware makes the console unmodified again. I'll give you a basic example. I broke my leg and at the time it was broken it was broken. After 6 weeks the fracture was cured and my leg wasn't broken anymore. Logic can be really simple, you're just trying to make it a lot harder then it needs to be. Running stock firmware does indeed make a console unmodified again
 
I'm looking right now at my Xenoblade 2 EUR copy and it says, literally: "This product contains technological protection measures. Unauthorised commercial use prohibited. To avoid ingestion keep the game card away from young children.". It doesn't say you need an unmodified console. This is different for L.A Noire? Can someone upload a photo of the back of the case?

Digital, as it's a digital product even if "packed" into a physical cartridge. If you buy a DVD, is it physical or digital? Same concept applies.
Winner gets 100 points. And as per kumikochans source you only get the right for an immediate refund if it fails to work. So this means:

If you buy it and it doesn't work (cause you can't download the additional content) you can refund it,but only immediately.

If it fails at a later stage you presumably can't (or possibly have to prove that the defect that caused it to fail to work was already in place at the time of purchase.

No, you are wrong. Running OFW does not instantly put the console legal again. The ToS were broken the moment you injected the payload in RCM. Once you broke the terms of service, running OFW will not correct that.

Yes, the console may be "unmodified", but you broke the terms of service anyways.

Did I claim that anywhere ? I'm talking about the claim C80 did that running a game on an unmodified console makes the game playable. So I just stated it this way to show why what he said is flawed.

This being the comment he made.
The box clearly warns you that you may not be able to play with a modified console, so it does NOT break the law

If you buy it and it doesn't work (cause you can't download the additional content) you can refund it.

Most sellers will refund it, but they are not legally obliged to. (unless faulty cartridge of course)
If you explain why it doesn't work (console banned), the seller can refuse the refund.

No, it isn't, in Europe they have another age rating system called PEGI. Also, i've looked my another game boxes and in Zelda/ARMS/Splatoon2/Bomberman/DOOM it says that if you modify the Switch, they can render the software useless. But whatever, if it is illegal (i'm not a lawyer and i don't know), their threats are useless.

Try it. Take your game out of your banned console and put it in an unmodified (as in NEVER modified) console. It will work
