As people said, everything that you can do on a non banned Switch except go online. It's also going to depend on the level of your ban

I was under the impression that regular eshop/online bans were upgraded to a full CDN ban? I know that's what happened with one of my consoles.

They have but not ALL of them have, only a few people reported that. Meaning it could be a gradual thing. And i think it's only e-shop bans that were upgrade

Not all of them, least not according to their reports
Yes but probably they are not telling everything they did, I havent used freeshop or similar and havent been banned at all, you must sin before getting banned, I can even say nintendo sent to my house a death squad to warn me about it, we have to believe in the word of users without proof, well no because most people that got banned were desperate to use the eshop services, so they used cdn to get those using freeshop or at the time cdnsp with their own cert

A thing to keep in mind though is that not every ban is an instant ban. Using freeshop or cheating online sure it's an instant ban. But for example going online while on CFW or having backups installed can get you flagged and if so you'l be banned during the next big banwave. And there is no guarantee that THOSE bans wont be upgraded into superbans to avoid the certs being used for CDNSP for example but only time will tell when it comes to that

I have been using freeshop for a few weeks now with no ban. I am not under any presumptions that a ban is not imminent, just stating how my situation is at present.

i have used freeshop one time, for one game : standard ban, one week later superban

my mistake : my daughter played at pokemon quest (legally acquired) and said yes for an update while online with CFW, maybe she did the same for an other game (NSP game from CDNSP...)
I don't know but it's entirely my fault : CFW = Airplane mode :-)

Has this ever been the case with previous systems?

It hasn't AFAIK. However Nintendo have ported these security features onto the 3DS to prevent stuff like FreeShop from working completely. They can't do the same kind of bans since the 3ds doesn't exactly have a cert like the switch does but they can stop you from accessing their CDN completely

This means it sets prescedent for Xbox and Sony to do the same to their machines.
