should i try calling Nintendo and saying like i bought my switch used and am really upset and something or other and say that i can't get in contact with the seller or something?

They would more than likely tell you that since it's not under warranty, there's nothing they can do.

They would more than likely tell you that since it's not under warranty, there's nothing they can do.

Yeah, when you’re just into homebrew, and not pirating games. It’s a pity you get banned.
Sure, it’s still breaking the TOS, but you’re not stealing away money from them, you’re still buying your games. So maybe’s just turn a blind eye to those people

Or, we buy a second Switch.
Or, we just accept the possibility of a ban.
Or, we just don’t hack.

That’s pretty much the lot of it.

Tell you what I've been thinking, if this "new" Switch comes out with more RAM, assuming that's just not a dev unit, I am considering hopping ship to that one as my legit unit and using the old one for homebrew... but it kinda defeats my purpose of trying to have a sort of an all-in-one device. It really SUCKS because the Switch is ideal!

Backups updated? CFW/OFW/N > Y, i updated my backups/XCI files through OFW. I turned on internet inside OFW, and updated only one game, waited 24 hours, and updated the next. It seems suspicious to me if you update 4-5 games at a time. I disabled internet and enabled flight-mode when i was done each time.

Additional Comments I dump all of my own legally owned games using WAIN 0.0.3 with certificates, and only play my own legitimate dumps. I don't download/play scene releases or other pirated dumps. I have played games like Mario Kart 8 Deluxe / Mario Tennis Aces online with no issue since I started using SX OS. I pretty much have my Switch booted into SX OS exclusively and use it exactly like I would a normal Switch.

Well he used SX OS + homebrew which is grounds enough to be banned if Nintendo is smart enough. At the very least, he wouldn't be the first to be banned like this. Anyways, I agree, I would like some video evidence as well.

But.... you were asking about telling Nintendo you bought it used. If you tell them that, they will tell you it's NOT under warranty. Their warranty does not cover 2nd hand systems.
