Atmosphere is open source and sx os is actually free so tx aren't really making money out of the cfw, they're making money selling their back up loaders which they're the only ones providing it right now.
 
A lot of people in this thread seem to be in law school! Who would have known we have so many lawyers-in-training on de forums! lol Reminds me of a buddy of mine who whenever he gets upset at a company he says "I'll SUE your a$$!" And I'm always like, "No you won't, you are broke and are complaining about a cheeseburger..stfu you sound like an idiot"

Anyways, this is about "moral" obligation and everyone has a different idea of what that is. Which is ok to steal from? The big corp or the mom and pop's shop. Many would say the big corp is a piece of crap so take all you can, but leave the little guy alone. Then again stealing is stealing right? Morals...everyone has a different concept.

I personally won't pay TX a dime for anything and will wait (although that dongle would really be worth it..) But far be it for me to say anyone else is wrong for buying their products. Im not a fanboy and Im not a hater, I just have my own opinions. Too bad people can't be civil and show how they feel in actions rather than cursing at each other about it. Sounds like the US gov't

Really? Wasn't SciresM the one trying to crack it who discovered the brick code? I'm getting confused with all the names involved.
Technically, it was one of the members of the ReSwitched by the name of hexkyz
SciresM's number one priority has and always will be Atmosphere until its done. After that, we have no idea what he will do.

Can somebody tell me why TX has relevants with China? As a Chinese people, I always think it's a foreign group, and it don't have a Chinese name, even their website is full of English.
 
Here does the stolen code come into effect? Because you only pay for backup loading so everything else could be considered freeware. And China is not very fond of patents and licensing anyways.

The problem is not that it costs money or not. The problem is TX did not credit the people whom they used the code from. Its basically plagiarism, in a nutshell. The point of open-source is that anyone can use it, but if you do, you have to provide your own source code.
 
I do get the point. Still it's China so...
They've already indicated they have no such plans for pursuing legal action.

From what I know, it's the people that actually manufacture the cards and devices that are located in China (presumably because it's not legally allowed to make a piracy flashcard in the EU or the US). As far as their dev team goes, I'm not sure where they're located, but I think that is actually the United States.

The problem is, nobody really knows who is on the dev team for GW/TX, so this is all speculation.
 
Let's blame developers for making open source software. If they didn't release any source code, no one would be tempted to steal it, obviously.

1. You seem to not realize that if Atmosphere didn't exist, neither would have """SX OS""". (at least not for a long time)
2. Now that we have established why Atmosphere is important, saying that no one cares about TX stealing code shows how much gratitude you have for Atmosphere devs and their hardwork. (no gratitude at all)

You people literally deserve nothing.

Correction: TX announced their dongle last year. We don't know anything about the timeframe in which SX OS was developed. For all we know, they couldve stolen the source code from Atmosphere (plus the also GPL crypto lib they use for licensing, its not just Atmospheres license theyre violating) the day before they released it and mucked it together.

From an outsiders viewpoint it looks like this:
  • TX announced "guys we're gonna make a dongle"
  • RS discovers f-g, keeps it private but announce they have it, starts work on Atmosphere (note: Atmosphere is clearly announced as being in development, meaning we can take its timeframe to heart)
  • Anon publicizes f-g about a month before it would become public.
  • Atmosphere and f-g are hastily made public by RS.
  • TX talks for the first time about SX OS about a week later.
  • A few weeks later, TX releases SX OS, SX OS contains Atmosphere's loader code plus code from the Homebrew Launcher.
All TX said was that they were making a dongle. They never talked about SX OS until Atmosphere was made public. This gives me enough reason to assume that SX OS was not in development until Atmosphere was made public.

SX OS contains exactly two bits of original work that isnt lifted from somewhere else:
  • Their custom bootloader which displays the menu.
  • The removed signature patches.
The rest of their code is borrowed code from Atmosphere and an old build of nx-hbmenu (whose license they also violate, they need to add a copy of nx-hbmenus license to their OS to comply with it. No need to license it to the ISC license, that is not required, but it stands that they still don't do that afaik).

In addition, whichever portion (reading hexkyz tweets seems to imply it's all of them) handles the license checking is also stolen code as they use a GPL crypto library.

Every group is hacking the other group. Props to the switch hacking scene :) it's on fire and that is a good thing ;)

They just thinked about implementing homebrew fonction in the last seconds

so TX only copied a part of hombrew launcher? then why these haters hating so much as if TX copied all atmosphere stuffs and assmosphere doesnt even have a proper back up loader.
