I've updated about 15 xci games via OFW, no problem as yet. I can't see how the cart's unique cert would be used in this process. If you had multiple copies of the same game cartridge for some reason, maybe you have multiple switches, you wouldn't have to make sure you always used the "correct" cartridge in the same switch. Different cartridges wouldn't create multiple entries in the horizon menu, they would share the same icon/save data etc. so the header is probably not used as a part of that system.

Have any of the proper experts in this area actually looked to see if the cert for the cartridges is stored in eMMC when the game cartridge is first inserted? If it isn't, then there is no way that cert info could be sent to ninty when an update is requested, because you can download game updates without having the cartridge inserted.

Now for whatever reason, even a banned console can still grab game and system updates but they may decide to change that in the future.

It definitely deserves more research. If that was the case, then everyone running SX OS/Pro should be banned for simply running the CFW. However, more and more bans are continuously being reported so it seems like it maybe be less related to updating and more on whoever hacked their devices in the first place. Right now, we have to wait for the flood to end.

I have not played online with any of my games at all. Also not tried to update anything since using layered and only used free part of SX so no idea what caused my ban they must have some way of seeing I have played a game using layered even though I was offline. I have seen some mention that they are using error logs which is a possibility as I admit I have been lax in using the log clearing. TBH for me im not bothered about online as I have never used it and am not likely to use it (well I guess I never will now) my main worry was updating and seems like that isn't a problem as for Eshop it just means that when I get my SX OS it now becomes more useful.

I would have thought that layered is more of a risky (ban wise) venture than sxos, due to the system seeing sxos mounted xci's as cartridges and layered being a more messy/hacky method. As I said before I've been using sxos, with numerous xci's, since it released and have updated all the games I've played, and bought a few things from the eShop (all using OFW) and don't seem to have been banned yet.

Like you though, I'm not particularly bothered if I do get banned. Switch would be well behind my PS4Pro, XB1X & PC when it comes to playing games on-line, and I definitely won't be paying for the privilege when they launch the online sub thing in September.

Another useful thread from me, i've found a way to update your backups with the least ban risk !
How ?​
Okay here are the steps:

1- Play the game for few moments
2- Leave the game and turn off your Nintendo Switch
3- Boot your Switch by loading the payload while pressing + and select OFW
4- Configure Internet and update your games from the menu by: + button then choose Update, THEN DON'T FORGET TO REMOVE THE INTERNET CONFIGURATION !!!!
5- After the update installed turn off again the switch and boot SX OS CFW
6- Enjoy your updated games without worring about getting banned ! :D

OP you really need to stop acting like a man-child. The problem people have with this that is that you advertise it as a safer way to update games, but in reality you have no way to prove its safer.
Saying "people who have used this haven't been banned" is not based on anything for multiple reasons. For starters, the ban waves have just started. Not everyone is going to be getting hit with a ban immediately. It could easily be pure coincidence that you haven't gotten banned yet.

To add onto that, given that there are people who are saying they were banned using LayeredFS offline then went online without touching LayeredFS means that something was logged into the Switch while LayeredFS was running and was stored within the console that persisted despite a power off.
