Can I safely play online with my legitimately bought games if I de-mod/turn off CFW by restarting the console?

Hey guys !
I have a question, from what I understood playing online with dumps will end up with a ban, but if I play with my own games after a dump a ban might occur too right ? So will we be able in the future to do so or its hard to tell ?

Only if you sell or rent your game and go both online same time.

Playing your own backups could theoretically still be detected by Nintendo.
Different file name; both I think are named as payload.bin right;
The name doesn't matter but if you have multiple payloads on your micro sd card, each must have an unique name.

So even if I play my own cartridge games I can get banned ?

Think of it like this. Making backups are not the problem here. There is no official way to launch backups without hacking your console. Thus, if you are able to load your completely legal backup through an unauthorized modification to your system, whose to say that you won't do any other things such as loading illegal backups or cheating? Basically, Nintendo will ban you not for using a potentially illegal backup but for launching a backup in the first place.
 
Currently have 4.1 on my Switch and wondering what's the best option for running my backups/homebrew.

As far as I'm aware theres 2 options: LayeredFS or SX OS if I can purchase it. Keep hearing lots of negative reports for SX OS blowing fuses, random bans etc so even though it might be easier to set up... I'm happy to go ahead with the LayeredFS route to make sure I don't mess with the break any hardware. Also happy to update to 5.1 for LayeredFS as 4.1 seems like firmware that's not going to have a coldboot option anyway.

So... SX OS or LayeredFS for now? Just looking for opinions and potential lazy person videos/guides too. Yeah I know there's one on Tutorials section for LayeredFS.

Okay thank you for the reply ! Last question can you play your game as you normally do without using a dump. Playing as if your switch didnt have any modification ?
