We need is a way to load updates offline and have a server like X360 RGH had which we could even download updates trough the custom dashboard Freestyle from X360 it self.
 
You are still loading a game with an invalid cert unless you dumped your own for that specific game. And you are connected to internet when you do it, and then you are requesting update data for that game.
Yeah, totally not going to get banned doing that.

Well no one knows if he's right or wrong, we have no idea if horizon keeps the cert data from backups you emulated from sx os, even if you boot back to OFW there's no way to know if the cert data is still on the system storage and sent to Nintendo when requesting an update, that's the point.

1. Update the game
2. Attempt to play the game online
???

Or does it automatically check your games once you have an active internet connection?

You are loading the game before disabling internet, and you are connecting to online services for update download. It's not a guarantee ban, but you are very open to heading the system phone home with telemetry and tell nintendo you are inserting a game with no valid cert, especially if you are trying to get update data for it.
Doing anything with online connectivity after pirating with SX OS is a good way to get banned. Wouldn't surprise me if it is already logging the fact that the game has no cert.
I read and understood the instructions perfectly. You seem to not comprehend how easy it is for Nintendo to detect piracy this time around.

Frankly we don't know. Theres a lot of unknown info that gets sent to nintendo via telemetry. Wouldn't surprise me if it phones home log info of what you insert and play

Thts what im wondering is there going to be a way to update games like the 3DS? or well people who dump have to update the game then dump it with the update?

If you have friends with a switch or family with it. Just use the Match Local Version make sure you do not use wifi. You cannot use airplane mode so just no network connected and do the update.

i just updated 2 games using this method and worked perfectly fine.

Another useful thread from me, i've found a way to update your backups with the least ban risk !
How ?​
Okay here are the steps:

1- Play the game for few moments
2- Leave the game and turn off your Nintendo Switch
3- Boot your Switch by loading the payload while pressing + and select OFW
4- Configure Internet and update your games from the menu by: + button then choose Update, THEN DON'T FORGET TO REMOVE THE INTERNET CONFIGURATION !!!!
5- After the update installed turn off again the switch and boot SX OS CFW
6- Enjoy your updated games without worring about getting banned ! :D

I told you about it. But as long as your not doing auto RCM you don't have to boot any payload to do that because it should just show on the home screen after using the game the 1st time as the system thinks its a cart.

If the problem is "Someone else used the same cartridge, and Nintendo can see a lot of people have used it", what about real used legit cartridges?
I can buy a used game, so I and minimum another one sharing the same information about it.
Nintendo can determinate for sure that we are using a backup if more than one play online at the same time but I can give my legit cart to a friend - this way he and me send the usage info to Nintendo in a very restricted time, like we are using a copy, but it isn't the case.
We have to investigate better to understand what can cause a sure ban
 
for anyone wanting to know what info this gives with keeping the cart info on the home screen let me put it this way uninstall any game that you own the addon for then go to the nintendo store and download the addon only and it will show on the home screen like if you had put the cart in the system so my guess is that it stores the header info and some part of the game file but if you also think about it if you let your family barrow the card would they get banned for having the same header installed on there system when they update?
I would say its a 50/50 on a ban.. its possibly safe.

Yeah, sounds believable.

But since most online backups will be used a 100 or probably a lot more often it should be easy for Nintendo to detect those bad certificates.
