You think that Nintendo can determine if you once insert the game cartbridge or played it from XCI/NCA file while you was offline? I don't think, because when you will update the game you will be in OFW with a different game in cartbridge but they don't know if you really played this game while you was offline.
I don't think they can currently, the whole point is that it acts like a real cartridge. They could implement some anti-piracy checks that can tell the difference in future updates but I don't think they've had the chance yet.
That doesn't mean it's safe though, since everyone using the same ROM dump is effectively using the same "cartridge". But if it never sees the cartridge as inserted while you're online, it should theoretically be safer, since at least Nintendo won't see that you're online with the same cartridge inserted as thousands of other people simultaneously.

The game is just saved as a cartridge and you can update it without problem because the information of the cartridge isn't registered
It's pretty safe

Are you sure the information of the cartridge isnt registered? I mean, i dont know, but i dont think you know that neither. You may be right, but if thats the case, how do you know its like that?

They know, i mean, the 3DS has a game log and that is send to Ninti.

I dont see a reason why it wont be the same on the Switch, we have a game log, we can see playtime and all that stuff.

At the end of the day, neither you nor me knows that, so dont go saying IT IS like that.

I mean, yeah that could be it, but is far from confirming your theory. Just speculation.

Still, belive me, i wish you are right, so we dont get banned or anything, but as of today we cant know for sure, so better not risk it.

i am updating the back ups , with no problem at all , already updated rrabbids , mario kart , arms , kirby star alliance , zelda botw .
without none of those steps .
And the great thing is that the games i already sold kept the save file even playing a different back up ID :-)

That is what boginstaller is meant to be but its still a work-in-progress.
