When I read all the story's here in this tread... HOW on earth can you get banned when buying a game code on a shady website?
This is in NO way against the rules of nintendo.

Codes can be bought with a stolen/hacked CC, then once the owner of the card does a chargeback Nintendo will know about it and ban the user of the code.

I had a Splatoon 2 from psngames.org for a whole year
And never got a problem

those switch accounts with cheap games (really tempting offer) are known scam in Chinese community. he got into the situation himself...

no, they claim is purchased with code, actually it's just directly from eshop.
download code can not be traced down to which buyer nor related cc...

those sellers they wont waste redeem code for scam

So you bought an account that gives you access to the game instead of the code itself? They do it a LOT here in Brazil with PS3 and PS4 games, and Sony always ban consoles after sometime. I can't imagine Nintendo not doing the same.
You're naïve and somehow... stupid. You should have at least disabled internet when playing in this account.


Also, all people who bought the same game and are using the same account as you over the world were probably banned too. That's what gave nintendo a hint that your game was pirated. Like, at least 10 or 20 people using the same account all around the world at the same time? You should've thinked about it beforehand.

Also, the Terms of Service you accept and the warranty state that you shouldn't use other people's account. So you're in a harsh situation.

I would call Nintendo support again and say you had no clue you couldn't buy the game from that site. But maybe he got temporary banned?

On PS4 it is also prohibited to buy games with their accounts and also might lead to a ban...

One or more guys reported here long before if I remember well... But one I think he commited kinda a credit card fraud by going to PayPal and claiming the money back "by mistake" LOOL.

I wonder who asks 4 money back by mistake... And he claimed he had fixed the issue and paid back but he was still banned and Nintendo won't unban.

In all seriousness, you have 3 options:

1) Keep contacting Nintendo support (and be glad that they have an actual support in US, i'd be screwed if I had the same problem) telling your problem. If that doesn't work, you COULD go to some kind of "small cases court" (there must be something similar to that in your state). It'll be kinda painful to gather all information you'll need to present a case, but in most... cases, you don't even need a lawyer to do that. Nintendo probably won't send anybody and if you win, you'll be at least refunded so you can buy a new Switch. I don't know the shenanigans of U.S law, but it SHOULD work like that, but it will be tiresome.

B) Keep the things as they are and wait until summer for the fuseé geleé CFW release. Your chances to get unbanned will go from 0% to "something". And when people start getting banned more frequently, solutions for this problem might appear, just like on the 3DS. But if Switch works the same way, you'll probably need another Switch to clone its internal ID file. It's just speculation though. At least you'll have CFW to play offline and emulators.

B.2) Sell your console for a small price for some retailer. They can use its parts to fix it. OR you can sell it to some store and hope they don't check the online functions before giving you the money.

Toys R Us is (was? lol) a private (as in non-government) business, and they have the right to freely choose with who to engage in business - unless their reason is discrimination against a protected class

Toys R Us stores are also private property, and property owners are similiarly free to choose who can enter their property

(All of the above doesn't care about how business-stupid and/or bad for their reputation could those choices be; but they have their freedom of choice)

ALso in mercado libre there are people who sell games from eshop with 400 pesos ( like 20 dollars). They tell you that they need your acc and after they add the game at your acc, probably they use bins to buy the games.

I wasn't arguing against that; I was using it as an illustration for why Nintendo has the right to deny you access to the eShop if you violate their ToS.

Normally that is not a reason to ban your console. Byy law you're not violating anything since it has been purchased through a website. Nintendo Always thinks they're above the law, this is what happens when companies get 2 much money that they start to bully and tell you they don't have to listen to the law. And for the people saying that he's violating Nintendo's EULA doesn't mean jack shit. Not everything in a EULA is according to law. In that regard when i sell a product i can randomly put in a contract that the buyer has to not wear clothes for the rest of their lives and they have to do it because they signed the contract. No that's not how it works and Nintendo Always puts themselves above the law regarding their EULA

Well, we all know no one reads the EULA...

I think the random person with low money see a game cheaper and buy it without even knowing that they were breaking the rules.

If Nintendo was friendly after the person contacts nintendo support, they could have been more friendly and just unban him, delete the account that he bought from the console and advice the user not to buy games that come with accounts.

I don't actually find the person that buys them guilty (unless they knew what they were getting into), the sellers on all those sites are the ones guilty for selling "their" private accounts which are supposed to be only used by who makes them.

EDIT: I guess its like illegal drugs, they are prohibited, but in most places if you are just a consumer of drugs and have the small amount with you just for your own use, cops won't do much to you, yes its illegal, but they will care to catch the seller and not the consumer, only when you have above certain amount, you are screwed.

Here any illegal drug is illegal including marijuana, they didn't legalise it, however cops won't do anything to you if you have like one joint... What they will do is take the drugs from you and talk a bit to see if you can tell who sell it to you.

And for people that do heroin and that kind of shit they will try to put them doing a recovery program, the health centre give a free replacement for it which I think its called metadona which probably has a similar effect but its cleaner.

Now if you have a certain quantity you will go on court and jail off course.


ps: But like I said if you have no idea of anything and go to a site that sells cheap games you buy them and never thinking you are breaking the rules... So like I said if nintendo was more friendly after you contacting them and explaining where you bought and from who they could have unbanned and just delete that account. If they even cared more for it they should have gone against who sell them online, like contacting the site administration to not allow ppl to sell games with accounts.
