Hacking FreeShop; How Illegal is it?

Heres how i would answer the use of freeshop overall

Is it illegal to have the freeshop homebrew app on your 3ds homescreen? -No

Is it illegal for the person to host the source for the titlekeys? -Yes

Is it illegal to download the titlekeys from the source with or without the use of freeshop? - Yes

its illegal but nothing will happen so just keep on using it illegaly

FreeShop is not illegal, Nintendo would actually have to go to court and fight it to make it illegal. As it currently stands, the homebrew that goes by the name of “freeShop” is legal until proven by the courts to be illegal.

seems like its for piracy though since if you own the game to can just use the real eshop no need for freeshop.

The fact that it can be used for piracy does not matter, plain and simple. The homebrew itself, without the keys, is not illegal until a court declares it so. Nintendo would have to actually fight it, which even they decided not to do and only went after their code that was used. You fail to understand that piracy is not the topic here, the topic is about the app itself.
