I had a PS3, 5 months before official release and so did many others i know and the same applies to unreleased commercial games. It's not what you know, it's who you know and the type of work your involved in that grants access to such things.

Yeah I gotten releases of games a week before the official date. Nothing special except the little fun surprise to get it before the release date, "instead of waiting til friday I can play it today on monday! Hurray!"

lmao yeah that means it took time. maybe not intentional waiting, but it still gave time for enough units to sell.

This is less than 3 weeks before official launch, I'm not surprised it happened at all. When I used to work in an independent game store and we would get a high profile title in (usually 1-3 weeks before launch) I would visit every other VG store in the city and talk to employees fishing for an idea of when pre-orders would start shipping, as soon as one store did it we would follow suit. Perfect Dark was a big one I remember, I think we let that one go about 10 days early.

We sold grey imports (I was living in the UK at the time) so we often had Japanese or US versions of games long before the PAL release, in those cases, where the import game was easily available in the UK (most Dreamcast stuff for example) we would sell the PAL release the day it arrived in store, regardless of release date.

Yes, but as I also said, we would follow the lead of the other stores on early releases, and GAME were commonly the first store in town to break an official date.

He also says he's out of the console and money. Well if I had a pre-order shipped to me before release date I would NEVER return it, no matter who contacted me. I have paid for it, it's my property now. I am not in possession of stolen property or anything.

Unless, Nintendo pays me a hell lot more than MSRP.

This whole story is quite sketchy. I don't think they would've asked for the console back 12 days from release, and when various media already have the console as well. Certainly the retailer would've had to reimburse him unless the plan is to ship it right back after launch, in which case, why waste the shipping costs?

I agree, could very well be he got it from someone who was not supposed to sell it, or stolen property.

Pretty sure Nintendo cannot force him/threaten him with legal consequences for something he bought legally.

But yeah , why a company would do that to someone who payed money for it? They should say something to the store that selled it , not the people who got it. smh
