3DS console with 42 games?

I saw this on ebay http://m.ebay.com.au/itm/NEW-Nintendo-3DS-XL-Metallic-Black-42-Games-USED-LIKE-NEW-/272557517296 and noticed that the description says, not once, but twice:
Please do keep in mind that this machine is legitimate. All games and content were purchased from the Nintendo eShop.

The games couldn't possibly be genuine, could they? I'm trying to think of a scenario where this guy would find so many legitimate games (for example finding consoles with no NNID and doing system transfers) but he'd have to be SO lucky to find multiple cheap systems, and even so, surely it wouldn't be worth all the effort. Even if all those systems were free it would take forever and ever to do all those transfers.

I kind of want to buy it just so I can get a refund from PayPal when I try system transferring and the games don't move! Is that evil? Or does this guy deserve it, selling pirated games and claiming them to be genuine? If they actually were somehow genuine, it would be a waste given I have the power to play these games for free any time. It would be a shame then that it has an NNID since I wouldn't be able to merge them with my own bought content.

Hmm, what to do, what to do...

People do that all the time. But the difference is instead of just selling rom files, they are selling an actual system with it. 100$ is a ok price either way. If you are a regular buyer you really shouldn't care, unless you are getting gouged at the price.

ALso to add, buying it would probably to much work and what if it is legit? Sell it again?

Look at that guy's feedback. He sold a normal 3DS with 239 games and got negative feedback, he obviously pirates them.

Yeah this is the downside! Maybe I'd try it if I don't think I'd lose more than, say, $50 when reselling it.

Yeah I saw that - but in those ads he doesn't say that they're genuine, he doesn't mention the issue at all.

If they have to tell people that its legit, more often than not its probably not legit
But either way $100AUD is still cheap af for a New 3DS

Its a auction so yeah its not gonna go for $100.

True, he usually sells them with 280 games instead of 43 as well. Still very unlikely to have legit purchases on them, perhaps he did this so it looks real.
Also I just realised he doesn't accept Paypal as a payment method.

That's interesting - I bet ebay would have something to say about that.
Edit: just realised they take credit cards, which ebay allows instead. The bank probably wouldn't care less about piracy and wouldn't do a charge back, I don't think I'll bid anymore :-p
