It just installed fine through freeshop, I have no idea. LmaoTry freeshop and download the update. It will probably fail but if it does then there is a ticket signing error. I might say something like 'wrong ticket'.

Fixed it!!! After downloading the update through freeshop, I went to system settings, data, nintendo3ds, and it showed the update installed through freeshop so I deleted that and reupdated at the home menu and it finished.Try freeshop and download the update. Yep, that works, but is not only smash update, in my case every previous purchased game does that, and download it from Freeshop, and later delete it to download it from eShop, is the only solution I can find.Fixed it!!!
