They need to know everything about the exploit and also work with the devs to fix the issue. Most likely the delays with the DSiWare downgrades is because it required so much effort to setup and paid games. Which really bought them some more time to push out updates to the system. Of course once it was found out that you could pirate Fieldrunner, then use that copy to get a legit copy. It caused them to pull the game from the eShop.

For any title that can be downloaded from the eShop and that you've previously pirated, it allows you to be able to legitimately purchase it from the eShop.
