I'd like to know what those affected by the second ban wave did to trigger it.
Connected to anything in-game or just played the game with WiFi enabled but didn't use anything inside the game?

There was a user who experienced a ban only after reboot so this could be a first-wave ban as well. Anyway, the game is out in 10 minutes

so that makes two of us survivors. The eShop release is out in 5 minutes or so. Are they going to continue these banwaves after the release I wonder

I don't know, ill wait till its either on eShop or something :v

Well they would manually lift a ban that's due to expire in 15 days if the patron didn't receive the ban themselves. It wouldn't be morally sound to just say "Oh well it's only temporary, you'll be fine in a week!" After buying a new console? No one would do that.
So then we have our fix. forge a receipt from a secondhand store/pawn shop. call nintendo. claim you bought the console already in a banned state.

Thanks for telling me!
Mind sharing what exactly you did prior to the ban? Connected to anything in-game such as GTS, Wonder Trade, Mystery Gift?
Just went on with wifi enabled? Did you share to you friends the game you were playing?

I accidentally connected online on Festival Plaza this past Sunday. -___- I have no NNID on my device and only got the 002-0102 ban. eShop works just fine for me so that's good at least. I was hopeful that I dodged the bullet yesterday since everything worked fine. But when I checked this morning, I got the 002-0102 error for Friends List and Animal Crossing New Leaf.

Had I told them that I got banned myself, then asked to be unbanned then I could see what you mean. That wasn't the case though. As far as they were told, I bought the console used, turned it on and got an error message. Why wouldn't they manually unban whether it's automatic or not? They aren't going to punish a legit patron for the action of the previous owner. Hence the reps advice, after the fact.

Ah, I feel sorry for you m8 :(
Did you purposely establish an online connection while being in festival plaza or did you just open festival plaza and that alone was enough?

I've connected to the internet today and still nothing.

Which people have already been doing. it's not a fix unless you can actually print on receipt paper, or similar in size, shape, font etc. A photocopy invoice won't fly I'm sure.

Tbh i have no option but to lie to ninty.
Ill tru to make support ticket or something saying i borrowed my ds to friend for a month, he installed moon and got me banned

So you are going to openly admit that you run CFW? That's also not allowed.

But, if Nintendo keeps getting reports like this, they may think the game market is being flooded with used banned consoles. that would hurt sales. maybe they'd lift the ban after a while.

Won't matter, you essentially shared your ToS agreement. Same thing as "My kid bought this on my credit card, not me!" While it does happen they give customers benefit of doubt, 9/10 you have to prove there was no way you could have done it yourself, or accept the fact you are SOL.

That actually makes sense, and it IS happening. Perhaps it will make GameStop and the like start checking for bans before taking trade ins too. Right now they don't even check the wi-fi card to see if it even works.

I established an internet connection while in Festival Plaza. I was an idiot, yes I know. :/

To give you guys more context, I have a 2nd 3DS with Sun installed. I also played Sun with Wi-fi enabled and did link trade with my 1st 3DS (the one that's now banned), but never went online. This 2nd 3DS is not banned even now.
