So I have a arm9hax o3ds xl would It transfer over the arm9 to new 3ds and would I lose anything else

The N3DS will not become magically hacked by doing a transfer. If the N3DS is on 11.x you have to do a DSiWare downgrade.

You will need to hack the target system because system transfer does not transfer arm9lh.
