So the answer is, don't post links to copyrighted material.

Also, wouldn't it depend on where gbatemp is hosted rather than where people post from?

It's not about where the Temp is hosted but rather about where the companies that might put a squeeze on us are located. Like how PayPal refused service to stores selling flashcards, and so on.
