Yes there's one or more userspace bugs that got patched on 5.5.1
So by definition one of the conditions in the OP has been met for the release "- If it's patched : if a new update comes out and patches it, MN1 will not keep it hidden.".
Unless MN1 changed his mind ofcourse ^^.

In before Hykem shows up saying he'll try to port the exploit to 5.5.1 and we have to wait until March.

Hykem already said that will not delay if there was a new update!!!

The bad news is that I'm going to postpone the release again. I said this week would be a more realistic release date, but I never confirmed it would happen then. Still, it's not a huge delay and it's definitely not to wait for a new firmware update.

I am actually glad Nintendo released an update and patched some bugs because I see some activity from the devs now. Maybe at last the userland exploit will be released for 5.4 and 5.5 and we will have these until Hykem works on his thing. In Mr Rean we trust!

I could easily release it today, but given it's instability, I don't want to open up that can of worms on this forum. Since late December, I've had the intention of rewriting the exploit to improve its stability. My hope is to do that before release, but if people care that much, I can release the unstable one in the meantime. Just don't come bitching to me about it.

If you do that, I'd recommend making that a sticky especially the last part

It's all up to you mate , am honestly not in a rush, others might be, how hard would it be making it more stable before the release?

Difficult (but fairly deterministic) process to make it work initially, and it sometimes fails to run afterwards.
