errr i think maybe i got a bit confused , basically i thought that post was saying you would need to access a youtube channel to install, and iirc the youtube app uses the same webkit as the o3ds browser that was exploitable......i think maybe im just getting carried away with my assumptions XD

The YT exploit could be real, you can access any website from it and if you go to go.gateway-3ds.com the app will crash, an error message pops notifying that the app crashed and the 3DS will reboot.

nope, same reason why there is no cfw for 9.3+...patched exploits,even though the browser was still exploitable upto 9.5

nope, again exploits patched on 9.3+ means no exotic stuff will work, i.e cfw/downgrading etc etc unless smea has more tricks up his sleeve, and even if he did i doubt he would share those tricks

He's not saying it won't happen it's just not coming from white-hat golden boy smealum. Maybe look towards 'soon' and 'around the corner' for your 9.9 warez needs.

yeah ofc its "possible" but completely totally reliant on new exploits being found/released....gateway gave the community most of the current exploits (or at least proper implementation of them publicly)...if anyone could do it, it would be GW........with all the CFW's i doubt they can be arsed looking for new exploits
