Hardware Nintendo thieves ?

Hello, I bought a Nintendo WiiU for my son last December.Playing Lego City , the console is off several times, until no longer recognize the Gamepad.​
I naturally sent the Nintendo console since the SAV is new.​
Today , I received an amazing response from the SAV, my console is down and Nintendo claims me € 210 to fix it, the failure is ignored by the warranty.​
My WiiU lived only 88 days and is not taken into account by the warranty.​

Note that March 17, 2015 minus December 19, 2014 is 88 days, which is less than 90 days. However, it would seem that the warranty in Europe is 1 year anyway...?

You could try sending them an email along with some documents that prove that the warranty is not yet over. If that doesn't work, sue them

OMG....Nintendo is lately doing absolutely everything to kill themselves!!
First their stupid account transfer thing (why the games are not tied to account as on PSN is beyond me?!), then fragmenting 3DS users with N3DS only games, not including freaki'n charger with 3DSX XL and all the newer ones, not covering warranty and jumping like tiger on every YouTuber who puts some N related video....
I love their games, but they are just confirming each day that they are pricks!
I hope they go the SEGA way(well not exactly like SEGA's deteriorating game quality :( ), so I can play their awesome games on some normal consoles

Just call them today and complain that your warranty is perfectly valid and request an explanation for why it's not covered under warranty, since there doesn't seem to be any reason why it shouldn't be covered.

This, indeed. As it stands, there simply isn't enough information on any further action whatsoever (unless Arnodorian is an expert on copyright claims...which I seriously doubt :rolleyes: ). A connection problem between wiiu and the gamepad is in no way a small issue and normally should be covered by the warranty. You really want to know why nintendo even considers thinking otherwise (note: that 'non couvert par la garantie' seems to indicate they at least acknowledge it being returned within the warranty period...which indeed should be a year).
Also interesting is that they make the claim that both the wiiu and the gamepad have an issue. And that's not likely at all. One of the first things they should have checked is whether the connection problem is on the wiiu's end or on the gamepad's end (for which they really don't need anything but a spare wiiu, another gamepad and about five minutes of time). Ask them about this, as this sort of leads me to suspect their tech team hasn't even done basic checks before closing the call.

I can be a hypothesis. I have provided a copy of my proof of purchase together with the console. Imagine that Nintendo have not received my proof of purchase , it will explain the unsupported SAV.

I had completely forgotten that the homebrew channel was set up to test and develop our dear homebrew. But Nintendo thinks I'm a pirate and canceled the guarantee. I am at fault, but again Nintendo is opposed to amateur development.​

The terms and conditions for a warrenty include not tampering with the hardware or software of your console.

If you do that you void the warranty.

Are Nintendo opposed to Homebrew dev, yes, why? Well has anyone ever made money from it? Hav any Homebrew games on the Wii, DS, Gamecube etc ever actually been released officially? I don't think so, from the big N's standpoint its just an entrypoint for stealing games, whether they're right is beyond the point, point is they make a condition, you ignore the condition, its not their problem anymore.

You are supposed to remove that before sending it in. Now you will have to find an unauthorized repairman who can fix it for cheaper.

Actually by law its a minimum of 2 years (However even then you can usually (in Sweden at least) make the accept it up to 3 years after the purchase if you really can prove that you didnt damage it)

"I refuse and authorize it's destruction"?! Like yeah right, they'll probably just refurbish it and sell it.

But yeah if you had the Homebrew Channel on it you're out of luck. Pay the €13 to have it returned.

Not so fast. There is a legal mandate for warranty in Europe, and as long as that is in action, the other party cannot attach terms as they want. Obviously that warranty does not apply if you inflicted the damage yourself, but if the product is relatively new, the burden of proof is not yours. Any voluntary warranties granted to you by any party can of course have arbitrary terms.
Under European law, you have to claim warranty with the seller, though. The manufacturer is not your contract partner and can refuse your claim as much as he wants.

I'm from Europe... the Polish flag under my username is the giveaway.

Legal mandate or no legal mandate, if terms and conditions state something and you go against that, you agree that you've voided the warrenty.

In this case theres sufficient evidence that the console was hacked to a degree.

Claiming with the seller might work though, I had this issue a few years back, My battery broke on a a laptop that was 6 months out of Manufacturers warranty, but I had a 2 year warranty at the store, they kept arguing it was out of warranty and I kept explaining that my warrenty is with THEM, and I don't care about HP's warranty. I badgered them for ages and the store gave in. HP would have told me to screw myself as I was past the end date, but Currys (the store name) had to legally accept it, otherwise I wasn't going to give up.

But the store doesn't fix stuff, the store will replace the unit with no problems, but they won't fix it, because they'd send it to nintendo to fix, and they themselves probably only have a certain warranty length with Nintendo.
