So I was thinking, if we can install an older version of the internet browser on 9.5 using cfw/emunand, will this transfer over to another system in a system transfer? That system would then have an older internet browser, and could run the gateway 3.0 to downgrade. Can anyone confirm if the 3DS file transfer would send the old browser from emunand (thinking that it's up to date)?

I don't think system transfer will transfer system apps. Only DSiware and games/programs installed to SD card. Even if it did, it's not going to install an older version of something over a new one. Nintendo's security is bad, but it isn't that bad. :P

What I was hoping, is that it would only check if both systems are on 9.5 as of this time, and do a complete nand transfer (maybe spoofing the old browser to seem like a newer one would help? (does that spoofing break the signature?)).

A system transfer never preforms a full NAND transfer at all. It only transfers games and content so no core system titles or anything like that gets carried over to the other 3DS.

Actually only a few files from NAND are transferred in the system transfer process (the ones related to SD encryption keys, and installed titles, and some other small things like friend code/NNID and such), the rest is kept as is.

I thought about it.
It would be legit to get a 9.5 decrypted firm0, xor your firm0 partition to get a xorpad, then inject a firm0 from a 9.2 system.
It should boot with your 9.5 sysnand, but still vulnerable at Gateway browser exploit, which you can use to downgrade, and ninjhax.
An hard mod is required though.
