Well, I've had this 9.4-firmware 3ds sitting here for far too long and I've grown impatient waiting on GW to update. I got to thinking and am debating the idea of purchasing a new 3ds (of the same color) from a store such as Target. I'll check its firmware and hope it is 9.2 or less, put the old one in the new box, and return it for a refund.

I purchased this 3ds from CL but it is in fantastic condition. I'll pay in cash as well (less paper trial). Another option is switching the S/N on the 3ds but I'm not sure this is necessary.

Any thoughts or concerns?

I'm pretty sure stores check serial numbers... Mine do at least to make sure they match up....

Sucks if ur a Temper on there but we're a smarter bunch than that....I hope

Any sane minimum wage clerk will only check to see if the serial number on the bottom of the 3DS matches that of the box, the bottom plate can be easily removed and swapped .

Thanks for this idea! I will definitely use this if I do decide to go through with this. To other posters, I understand that return fraud is bad and stuff but is using a flashcart morally better?

Swap the mobo and don't connect ribbon or two. That way the store can RMA it as a faulty product and you get a bellow 9.2 mobo. Everybody wins ;)
If what I'm hearing is true, any returned product will go through the refurbishing process regardless of functionality. One more thing I will mention: since my ds is on a weird version, I'll update to the very latest to further lower suspicion (ie: how'd you get this device on a version from last year...all our 3ds ship with blah blah blah). This is probably overkill.

There's a number of easy ways to soft-brick the console to show the clerk that it "doesn't work" for the return process

I don't think so, the product doesn't work the way you want it to so you should be able to return it. I've done a swap when I needed a printer that weekend for a project and couldn't wait for an RMA to happen.

i'm %90 sure that's against the law and %100 sure it's just wrong

Why illegal? It's the same hardware they sold to the OP.
