Hacking Error Code 002-0102, Have I been banned?

I do not understand Nintendo.
This idiotic idea of banning hardware is going to cost them money and goodwill. This is clearly a case of the right hand not knowing what the left hand is doing.

Dear Nintendo,
You can not issue a hardware ban on NEW 3DS' when you stupidly removed the serial numbers from those packages.
Expect many 'happy' returns from banned consoles owners and 'unhappy' returns from people who unwittingly purchased those returned consoles.

Most general retail outlets wouldn't do anything like that. However, Nintendo is not likely to ban a person quickly enough to be within the grace period for returns.
 
You act like they're the first company to ban hardware from accessing online features when the hardware is used in a manner non-compliant with the ToS/EULA. We're the ones breaking the rules, it's up to us to keep ourselves safe from bans as best we can. It's not up to Nintendo to stop banning.

Your outrage would be justified if they actually bricked consoles, effectively making us lose the money we bought the console with, but that isn't the case. They simply stop you from being able to use their online services, which is well within their rights.

A perceived 'outrage' is only over the fact that needless money and Goodwill will be lost by Nintendo. And I'm not arguing who is right or wrong just the end result. For this argument, I just don't care who is right or wrong. If you believe that many will not go out and buy a New 3DS and return their banned New 3DS when the serial numbers are not recorded(or even visible) and the boxes are not sealed, then I'd like to live in your world is it just not the real world.

Let's sell 002-0102 consoles & legit carts used for publishing 3DZ ROMS on C2C sites! :P
I believe this will make more panic on 2nd-hand trading market :D

The goodwill is the mother or child who goes to buy a banned console @ the retailer because it was returned.

People do NOT have to 'get lucky' within ANY arbitrary time limit since they can buy a New 3DS years from now on to end of life without any serial number visible on the package and no stickers on the boxes because some idiot @ Nintendo thought 'people are looking @ serial numbers so they can buy older consoles. I know let's remove them. And stickers are ineffective and costly. Problem solved'

Not having a serial number does not mean retailers give you an infinite amount of time to return what you bought from them. They go by the date of your receipt. No receipt = no return most everywhere. Online retailers also have a record of what you bought from them, and when.

There are 2 New 3DS bought @ different times and the 'bad' is returned with the 'new' receipt.

How long does it take to switch logic boards? 2 hours tops?

If the retailer is stupid enough to not have safeguards against that type of thing, you can do that with a lot of products. But why keep wasting $200 (even if you get it back later) when you could just use private headers instead?

I just thought I was banned because I couldn't get on Smash Bros. before and my friends list wouldn't go online so I was upset. I use Smash Bros. with a public header too. But my friend list just started working so nvm. I'm also on EmuNAND 9.4 still and haven't used my 3DS at all since before the 9.5 update. There was an error message saying that the smash servers were under maintenance before, I forgot about that. Hopefully my 3DS wasn't flagged or something for attempting to go online with the Smash Bros ROM. I guess I just won't use online functions for now, I'll just use my physical Smash Bros copy or something. I have other 3DSs so I wasn't very worried to get banned anyway.
