Question is in the title

I can downgrade to 4.5 if that helps, currently on 9.2

So what can I do? If i downgrade to 4.5, coudl I use emuNAND? I read somewhere booting into Classic Mode will result in black screens if the sysNAND is 8.x+, so what if im on 4.5?

Would I be able to play my JP games on the EU console through this?

you can install a CFW after you downgraded. With this CFW you can install .cia files (you can convert games + regions to .cia).

but a downpart is that the "released "cfw´s are very unstable and wont work if you update the cfw.

Thanks for asking this! I was curious about this as well.
I'm still debating if I should go with gatewAy because we now exactly how the browser exploit works so I am hoping someone can make it so you can just load your backups from the sd card without gateway.

Also, it doesn't seem like you answered this. Can we use emunand without the red card? Say if I wanted to still use ninjhax on 9.2, then emunandw on 9.4 to play online?

installing .cia to sysnad can brick it. But with a CFW you won be writing to a cfw, but to an "emunand". And for booting classic mode you need the red gateway card (not 100% sure, but i thought i red something about it earlier).

ok i will clearify some things:

Gateway and custom firmware are different:

Gateway let you use EMUNAND. You probably know what this is and can be updated to 9.4. You can use emunand in 2 modes: classic (for retail games) and gateway(for roms etc.). Both modes require you to insert the red gateway card at startup. edit: and i don´t know if classic mode lets you play region free.

Custom firmwares are kinda like emunand, but underdeveloped. You can´t update them(so they will stay at 4.5), but you can install .cia files (which yhou can make yourself out of roms). Big plus is that you don´t need a gateway at all.

Is there not any way I can play JP carts on an EU system without a GW?

Classic used to be launchable without the red card, so if you go back to 4.x and then use an older version of launcher.dat from an earlier omega driver, you should be able to still use classic mode without red, albeit without support for emunands above a certain point. And like you, I'm unsure about the region thing.

Does the downgrade put you on 4.5 or 4.2? Ive heard people reporting theyre on 4.2
Hoping i can so I can use my ak2i haha

Some regions of 3DS Systems downgrade to certain firmwares, if your in the US, your system downgrades to 4.2, if you're in japan, you downgrade to 4.4 and if you're in europe you downgrade to 4.5.
