I have said this several times on this thread.
If you have spot pass disabled 3ds won't download updates. I have my wifi on all the time. I never turn it off. Still on 9.2, still no update downloaded, still no notification nag.
If I enter sleepmode with wifi on I will get the notification but just the notification. No software download. If I reboot my system the notification goes away and doesn't come back unless I let my 3ds on sleep mode again with wifi on and it gets the notification again. But with spotpass off there is NO UPDATE DOWNLOADED

I had spotpass disabled and all and still get the prompt on both my 3ds's, though. I only turned the wifi on after disabling everything update/spotpass related and I still get prompted.

Which was never confirmed to be the method like I mentioned...
People think gateway aren't smart enough to have their own exploits, so will use others work, like the original ds profile exploit, which was by some name i don't remember.

Let me take a stab at this...

I got this email back from Gateway yesterday, but I was asleep :P

If you get prompted without an internet connection, the update is downloaded to the system and there is nothing you can do except decline the update.

If you get prompted without an internet connection, the update is downloaded to the system and there is nothing you can do except decline the update.

I know that, that's what I'm saying. Even with everything disabled, but wifi on, it got downloaded. Only way to stop it is by turning wifi off/deleting internet settings.

I already asked that question and TwoBladedKnight said two of his systems still downloaded the update.
