Call it my noobish nature, but I have decided to put the use of my sky3DS on the line and have updated my 3DS XL for the benefit of everybody else.
My sky3DS is still recognized. Booted and played Omega Ruby without issue. Firmware version 9.3.0-21U

So it blocks ninjhax but not the Sky3DS. So homebrew is more of an issue to Nintendo than piracy of their latest titles. Okay.

Probably more like the exploit they patched up for ninjhax was very simple for them to do.

Again, turn WiFi off, I fail to see why people are flipping their lids over this lol. This update shouldn't come as a surprise to anyone

Nintendo releases update - Mass panic!!!

because this is a big update, just like 5.0 was to 4.5, this will most likely stop all the goodies we could get on 9.0-9.2

I dont think Updating 9.2 to 9.3 is the problem lot of us poor bastards ordered Japanese ones and didn't arrive yet and 100% chance they are 8.X fw.

You may be lucky and a new release might come with 9.0 to 9.2. Keep an eye on new releases.

Did ya know the N3DS doesn't have a "WIRELESS OFF" switch? It's all by software. In fact if you disable it and go into internet options, the console can enable it on its own

PANIC

Surely you can just not add an internet connection at all?
