Hacking Gateway payback?

I VOTE THIS THREAD BE LOCKED.

Gateway are offering people to return their cards and bricked units to resellers and they will have a go at fixing or give new units.

No, the computer ships with a BIOS, and then you managed the OS independently. It's the same thing here, the Gateway has the bootstrapper that it uses to manage Launcher.dat, treating the Launcher.DAT more like the OS instead of a BIOS
Are you saying that a product that bricked your 3DS is not defective?

Would you send your 3DS to them after they released code that intentionally bricked your 3DS?

forget about the analogies, what you paid for is not defective.
if you believe what you downloaded from the gateway website is defective (as in, the latest version with the bricking code), then ok, that is your opinion.
but what you paid for is not defective.

You didn't purchase the Gateway OS, it's provided free of charge. You bought a peice of PCB that is pre-programmed to look for a file on the SDCard, and then hand off execution to that file. If your system got bricked, it means Launcher.DAT was running, which means the flashcart did what it was advertised to do. Launch an OS.

Once again the hardware didn't break the DS the software did....you didn't buy the software.....I'm not being a fanboy here just stating that the case isn't as clear as it's made out to be

Actually they are correct. If the Gateway Carts came packaged with the software, then it will be part and parcel of the purchase. Since you download and install it for free post-purchase, however, it is not technically something that was purchased with the carts.

It would be similar to buying a laptop with no OS installed. What you bought is the laptop. Just because the manufacturer let you download a Linux distro from their website that was designed to work with that laptop, does not mean they actually sold you that copy of Linux as part of the purchase.

Neither does your purchase of the Gateway Carts in any way connote any services rendered aside maybe for warranty. The Gateway carts are pieces if physical hardware it is not a piece if software. And in all honesty, even with software,the line between whether it is a product or a service is very burry. For hardware, however, it is a clear cut product and not a service.

The same laptop manufacturer in the example above sold you the laptop, they did not sell you a service that allows you to surf, play games, read and make documents, etc.

Tbh even if I got bricked I think it's nobody's fault but their own.......it would be a bummer but the act of using any third party code was already highlighted by Nintendo to possible lead to a damaged console....wether the code was intentional or not, you still chose to run it....you should be atleast 50% responsible if not more for not following nintendo's warning XD

Are you saying the Gateway 3DS bricking the the 3DS when used for its intended purchase is not defective?

If the brick happens before Launcher.DAT is loaded into memory, then I would say yes the Gateway is responsible. If the brick happens after then the free software you chose to download and install is at fault

Cigarettes. If used as advertised, will kill you.

That is a known and implied risk.. The tobacco companies were sued and forced to place warnings of this risk on there products.

Gateway 3DS has not warning that bricking may occur if you use there product and it is not an implied risk.

It does.......I don't think that statement goes as far as guaranteeing it will always play them and won't break your console

This statement on the other hand I could sort of agree with if you quoted the correct bit

100% safe to use.

if your credit card company is a good one, and you are a good customer to them, and you are angry enough (it sounds like you would be) then i guess you will get somewhere because you will probably harass them until they do something, they most probably don't HAVE to, but it is their discretion.

but, as you can see, most of us agree that they shouldn't, as the gateway is not defective. you paid for the gateway.
maybe you can go to court and argue about what it is advertised to do etc, but, since the brick is caused my a BETA loader (right?) i really don't think you will have much chance there.
