Hi! :) So Im getting a Gateway 3DS tomorrow and was scared that my new 3DS might auto-update and make my Gateway useless :( I recieved a notification today that I had recieved something through SpotPass and that I had to update to use it. I pressed No and disabled SpotPass, but will it ask again later sometime, or even worse, auto update itself? :O Cant see any option in the settings to turn it off, but didn't it ask to set Auto Updating when first setting up the 3DS for the first time? And does disabling SpotPass effect StreetPass?

No, the 3DS does not auto-update. You will always be given the choice to update it or not.

So I should maybe just remove the internet settings? :) I could just switch off the button, but I use it sometime to play Local Multiplayer :P Will it effect StreetPass? :)

If it's already downloaded, turn on parental controls. It will allow you to block accidental updating, as you need to put in a code.

Thanks for the reminder, I should do this. Although there is no option to lock updates among the "restrictions" listed, does it happen by default when you enable parental controls?

Good idea! :D Do I need to disable anything in particular or just set Parental Controls on? :)

Just turn it on, it's on by default.

It will nag you, I believe, anytime you turn the system on or wake it from sleep mode. It's pretty annoying and I can see how people update on accident.

No, that won't happen unless someone else maliciously updates for you. You can't just "update by accident", it asks twice for confirmation.

Beware that even if you remove the Internet settings for your own Wi-Fi router, if you leave Wi-Fi enabled and visit a Nintendo Zone hotspot, the update will be downloaded and you will get the nag.

That's what happened to me! Now I have the annoying nag and the fear that someone else will pick up my 3DS and update it. I have turned parental controls on but can't completely trust 'em and am too scared to test it obviously! Can honestly say I've never regretted going to McDonalds that much!

As long as you have parental controls on and don't share your PIN with anyone, you'll be fine. If anyone tried to update, the 3DS would require the user to enter the PIN in order to go through.

No, IIRC one of the updates removed parental controls blocking updates, so even with parental controls enabled people will still be able to update.
