Nintendo takes down the Breath of the Wild randomizer mod from Gamebanana

Another day, another Nintendo DMCA takedown against fan-made content.

Just a few minutes ago, Nintendo issued a DMCA takedown notice against a widely known and popular Randomizer mod for Breath of the Wild made by Waikuter and hosted in Gamebanana. Effective immediately, the mod in question has been completely removed from Gamebanana with the quote "This Mod has been trashed for a rule violation", with the rule violation in question being listed as "DMCA Takedown".

It's important to note that, as it has been the case with other recent takedowns seen from Nintendo, this was issued from the domain "mm-nintendo.com", which is a MarkMonitor operator for Nintendo themselves to issue these kind of take downs and notices.

It seems that Nintendo has started to handle takedowns in what looks to be an automated/bot process through MarkMonitor, as several other places with mods and Nintendo assets, like imagery and its characters, have been receiving the same notices from that mm-nintendo.com domain, like in the case of Gmod and its takedown of 20 years-long Nintendo assets, and it's worth mentioning that romsites have also been receiving these particular notices as of late from the same domain.

Miyamoto is so pants-shitting scared about his final game being a flop, he is also trying to portray this squeaky clean reputation about the games he's worked on. Given what happened to Yokoi, I understand... Doesnt mean I condone it, though. Frankly, just as tired of Miyamoto's mood swings being treated as law by Nintendo legal for no other reason than he's a key employee there.

The titles might change or shuffle around; but as long as he is allowed in the Nintendo offices, you can bet on any given possession, he is calling the shots.

The entire reason, Nintendo betrayed Argonaut, was on Miyamoto's tantrums. Same with Rare. There is no way, you can tell me, he doesn't have enough clout to push his agenda in the same way Steve Jobs bullied everyone and everything at Apple.
 
Why are people even releasing Nintendo mods and projects on forums and stuff with their names/online handles attached? We all know by now Nintendo DMCA this stuff.

So take your mods and your projects, make some announcements in different circles and drop them online onto torrent sites and file sharing sites anonymously. What can Nintendo do about that? Jack zip.
 
The only thing I can see Nintendo having a point in here is if their argued about their trademark being used in this randomizer page, if not for that and If it was me in this specific situation I would confidently dispute their claim.
 
Well, to be honest... what exactly did you expect?
It's a mod, there's plenty of (nintendo game) mods and hacks that exist.
I'd expect it would stay around like the hundreds of other similar things.

What's wrong with writing a program that takes a file and reorders data in a different way?
(Assuming the mod wasn't redistributing real game assets etc)

A big shame, not just this but in general.
If I had millions of $$$ I'd fight it if it was me, (hopefully) win and get some US court ruling that this stuff is 100% legal and acceptable (as long as no copyrighted files shared).

But I get it, Nintendo is big and this is a very important game to them, they don't want cfw/hacks to get attention and try to shut it down. :(

I'm intrigued. What did Miyamoto do to Argonaut and Rare? I know Starfox 64 was handled internally by Nintendo instead of Argonaut, not to mention pulling the plug on Starfox 2 late in development. For Rare, I know they went over to Microsoft to make glorified mini-games and character avatars.
