After unbanning my new3DS after Sun and Moon, I'd avoid playing any 3DS game while connected to the internet if it's a hacked game, homebrew software, or any game that's not in your region. In the past I tried playing a out-of-region game online and got an error code relating to having to agree to that region's ToS and I have no idea how you can do that.
