Gaming Xbox Live Ban Question

I have 2 Xbox 360's and one is soft modded with the latest firmware by iXtreme; the other left untouched. The not hacked one is plugged into the internet and is used to play my legit games and play online. On my second Xbox I play all my "backups" and is not connected to the internet. I use the same profile for both. Can Microsoft know if I played pirated games when I go online with my profile on my not hacked Xbox? When they ban, do they actually just ban your console, or do they ban both your profile and console?
 
Microsoft banns the console not the profile.
Thus, I'm pretty sure they'd simply ban your modified console and leave your unmodified one alone.
I know they consoles don't hold on to some DRM information. I've got two systems myself (one upstairs and one downstairs) and I need to plug my upstairs system to the internet so I can play Castle Crashers or watch video.

When you get banned are you banned from market place or just playing games in live?
 
so in other words your account is not banned just the xbox its self
if you want to get online line again you have to buy a new xbox ( I think MS did it that way on purpose to sell more systems d: )

Well nowadays if a game isn't even properly patched then a flashed system won't even boot the game. There's only a very small risk of getting banned with a burned game, only tends to happen with bad rips or leaks of reviewers copies.
