He could easily turn off DMs. Not reasonable to deactivate your whole twitter because of some DMs.

Some people have a console of legitimately purchased games they don't feel like losing.

System transfer is still possible through a call to Ninty, backup of data to an external drive, and eshop spoof. Sell old console or give it as your next gift to someone, not really that hard, just a lack of motivation.
