It could (they tell that in their new policy that was updated with 4.0)
But they would never do that

Take for example it is secretly updating and the power turns out.
Owner starts the wii and gets the corrupt message, but he doesn't know how that ever could've happend (as it worked fine yesterday)

Result: Ninty has to replace many bricked Wiis, while they could prevent it
