I think the banwave has ended long ago. It has been around 2/3 weeks i've been online 24/7 (well, my 3DS is online) and nothing has happened so far. I've played Pokémon Moon, Animal Crossing, out of region games, cia games, playing on my flashcart and this far nothing happened.

That time on Freeshop will still show up on their records, so you could. But the chances are still very small.

I was banned shortly after the rumors of the banwave came up and I had just downloaded the new FE game the day before I got banned, so it could be it. Remember how Nintendo DS also had really late but big-name releases like Dragon Quest XI or something that had an anti-R4 code in it so you would get locked into the tutorial if the ROM detected a flashcart?

My o3dsxl was banned at the beginning of this wave. I've never installed or played any of the Pokemon, Fire Emblem or Monster Hunter games. Only game I've ever played online was the Badge Arcade. I've never done any save game editing. I'm on 11.2 and unknowingly had Spot Pass turned on. I do have Freeshop and Ciangel installed. I dont think I've ever installed/played any out of region game before. I did change from AL9H to B9S day one.

haven't touched my 3DS in a while, so when i fired it up, i was glad to see it wasn't banned.

So i think its safe to say the banwave is pretty much over and done with, but lets not count our chocobos just yet. let's give it 1-2 more months just to be safe.

The ban isn't game related. Nor is it related to previous bans. Newly cfw'd systems with absolutely nothing but FBI were hit.

The Public LocalFriendcodeSeed_B I got from that chaos site was banned. I downloaded the update for Echoes the other day as well.

Ignore this. I apparently wasn't banned.

    Underneath Nintendo HQ
OR caused my 2DS to ban! Well o use homebrew, freeshop, TIKdevil, etc with wifi and even download cias and tickets and wont get banned on my N3DS XL until and unless I go online in games and I don't doubt that! Yet unbanned my 2DS with friend seed on chaos site (actually could I have transferred from N3DS XL to 2DS Stupid of me )

I'm just gonna say i'm not banned yet, not gonna speculate why im not as I fit all the criteria except for save editing.

wow so from what i've gathered, it seems to me that the prime culprit for confirmed bans are the pokemon 3DS games.

...well then it seems im not touching Omega Ruby or Sun for a long time.

Not many people have been banned recently but Nintendo could always start another wave whenever they want

    Think it's worth the risk?

Up to you. If you only spend a small amount of time on unauthorized software, your risk is lower than if you frequently use it while online.

There will always be a ban chance just by modding in the first place, if you play online a lot then I wouldn't risk it but if you only play one or 2 games online like me it's definitely worth the risk.

I primarily Smash online, and I can always migrate to the Wii U version if I get banned. Or unban myself.
