Yes, it's just asking to update the theme index file. It has nothing to do with 3ds firmware.

Just don't.

When a Nintendo update appears on your Wii U and/or 3DS you usually either update it or you don't, not so much if it's safe as it's only Nintendo who takes part in doing these actions.

Btw, the Sonic Boom's theme looks pretty cool but the background song is freaking terrible!
