You can play online without ever being banned if you have latest firmware / use original game / run normal mode switch / do not have auto RCM installed
Am I right ?
(Of course you can use jig / dongle and its microsd card to play .xci games offline)
I would think the answer to this is obvious.
Nintendo designed Horizon, and the switch. They designed the server back-end that manages your eShop purchases. They know if you purchased something legitimately off the eShop or not. They know what titles exist as cartridges, which ones dont, and what the unique ID is for each and every cartridge.
Nintendo has ample data, and has incorporated quite sweeping data analytics on the switch, sufficient to identify suspicious behavior very easily. Remember, it is not just what data your switch reports to Nintendo, but also which data it does not. (By this, this is what I mean: Suppose you are playing Splatoon 2 illegally. Nintendo knows you have been playing Splatoon 2. It know when you played it, and against whom you played. However, your switch is not reporting analytics about our copy of Splatoon 2, because it is pirated, and the TX OS mods flag that as data Ninty should not get to know. Ninty can see this and finger you right away.)
Asking for a ban-proof product that is designed to facilitate illegal use of licensed software on a platform loaded to the hilt with analytics collection software is just plain silly.
TX can only do its very best to discover what methods nintendo uses to detect that illegal use, and to try to fake valid responses as much as it can, but they can only guess at what Nintendo knows, or is capable of knowing. Nintendo will always have the upper hand of that game.
Be sensible and think about this rationally. Nintendo can and will dispense bans if they detect you running software you do not own, or detect you violating the terms of their end user license agreement. That is just how it is.

I just got my SX OX pro, and it is working great...
I install the CFW and everything is running well.
however I have notice an issue on my switch that it wasn't there before.
(by the way ver. 5.1.0)
After charging to 100% and turning it off (completely, not sleepmode) for the night.
Next morning I take out the switch from my portable case, and I felt that is it warm (not in a warning hot level)
I check the equipment and it completely OFF also fan is OFF.
I but the dongle ad startup the switch with CFW SX OX.
And I notice that now a Im at 45% of battery.
So, Im loosing power just shutoff.
I don't know what is is the issue... is it a battery issue, or CPU is running on the back something like CMOS?
any suggestions?
It was still in RCM mode and you didn't shut it down completely.
You can test it being turned off by plugging it in your pc and then seeing if RCM mode is detected in tegraRCMgui. If it's not detected then it is completely turned off and you can put it in the case you have for it
yeah but you don't have to uninstall autorcm. Just make sure to hold it just to be safe 15 seconds instead of the usual 12 and when you have done that, plug it in the pc and launch tegrarcmgui. If that doesn't detect the switch it is completely turned off but if it does repeat by holding down the power button 15 seconds till it is turned offI will check that as you mention.
So, if it is on Auto RFC mode, the system is still working on the back ground?
I will try to fully charge, uninstall the auto RFC mode and check.

I will do check that (15sec button hold), because i do like the autoRCM mode, less steps, less gear-up.

You have an SX Pro anyway, no need to mess with the phone.
Hold the power button for 15 seconds as instructed and it will definitely be turned off.
