Could be an emuNAND thing though. Even though I have gotten the update prompt already, the system hasn't downloaded the update yet. The third time it appeared, I pressed A and instead of showing the ToS, it sent me to System Update (which is part of System Settings) asking if I wanted to connect to the internet to check for updates.
