Homebrew smashhax + Downgrading question(s)

So that day I made this guide: https://gbatemp.net/threads/noob-friendly-guide-to-downgrading-your-3ds-from-fw-10-7.418125/ on downgrading. Many people who are on 10.6/10.7 ask whether smashhax can be used for the downgrade.
I don't really know, because I own an o3ds. Is it possible to downgrade using smaashhax? Atleast to 10.5 or lower versions, to get menuhax running and downgrade through that? I dying to know, And once I'll get answers, I update my guide with em.

(one more thing) Is downloading 9.2 firmware CIAs piracy? Cuz anyways when you updated your 3DS from lower firmware versions through System Settings, it was not piracy
