I'm sure that's just a generic "cover our ass" scripted legal response. I've never seen the fan come on while in sleep mode. Have you?
Plus we would have a ton of burnt out switches since I'm sure nobody turns off their switch before throwing it in their case. I know I don't and mine still runs fine. I have an official case and there is no warning to turn off your console. Also the tegra has thermal trip fuses to prevent such a thing from occurring iirc.
The guy at Nintendo said the fan still runs in sleep mode and needs to draw in air to keep the system cool. Whether that is at a lower rpm who knows but I'm not doubting him. The reason I contacted him was because I have tried it myself and after an hour of being in the case, my case became extremely warm and I wondered what the reason for the thermal transfer was. The system draws in from the front and expels warm air from the rear. But if you want to play russian roulette with that theory of yours then who am I to stop you. I'd rather listen to official advice.
