I have been out of the 3ds loop for a while. I used the old red and blue gateway carts a while ago but want to use seedminer. Should I update my 3ds over the nintendo servers to the latest firmware so that I can use seedminer? Since I used the carts before there shouldnt be any CFW installed that would get me banned on an update right?

This really is the correct answer. It will inform you of everything, including how and when to update your console for Seedminer to work. Also, I'm certain that the latest firmware can't or hasn't patched Seedminer.

I am on 11.10 and I want to update to the latest firmware. I dont want to use "All Versions" method as I lost my blue gateway cart and Im not buying another.
It doesn't tell me how to update to the latest firmware.
