You'd probably be better off just getting a n3ds and buying it off the eshop. It would be way too much for the o3ds especially as homebrew. Honestly I'm not sure if the n3ds could handle it as homebrew.

Also, since it was already released to the new 3DS, we may have some legal trouble by making the same game for free.
